    • CARFAX Reports provide Confidence, Transparency and Reassurance to potential Buyers
    • If Seller has a current CARFAX, it may be uploaded with the Listing
    • If Seller does not possess a current CARFAX, Exclusive may obtain a CARFAX Report for the Listing, if available
    • “N/A” is the default entry if no CARFAX Report is available (Ex: Race Cars, Engines, etc.)
  • Pre-Purchase Inspection (PPI) Reports (If Available for the Listing)
    • PPI Reports provide Confidence, Transparency and Reassurance to potential Buyers
    • Seller has three options: (Buyer To Provide is the default entry)
      • Buyer To Provide (If Buyer desires PPI, Buyer will obtain PPI within Seven (7) days or other agreed upon time-frame, as agreed between Buyer and Seller, of notification to Buyer of Winning Bidder status)
      • Seller To Provide (Seller will obtain PPI within Seven (7) days or other agreed upon time-frame, as agreed between Buyer and Seller, of notification to Seller of Winning Bidder status)
      • Seller Attached (Seller attaches current Seller obtained PPI)
    • If Seller has a current PPI Report, it may uploaded with the Listing
    • If Seller does not possess a current PPI Report, Exclusive may be able to help Seller obtain a PPI Report through our Partner Network
    • PPI Reports are not required but are highly recommended to enhance the likelihood of a successful sales outcome
  • Trades (Through the Exclusive Auctions Platform, Exclusive works with Sellers that have expressed an interest in potential Trade opportunities)
  • Seller may adjust the Listing (pricing, text, photos, videos, etc.) at any time during the Listing Period through Seller Dashboard

– Listing Types accepted include:

  • Vehicles (Autos, Motorcycles, Aircraft, Watercraft)
  • Non-Vehicles (Equipment and/or Items, Ex: Engines, Parts, Memorabilia, Bicycles, Watches, Clothing, Shoes, etc.)

– Communication Management (All Communication between Bidders & Sellers is Monitored & Managed through the Exclusive Auctions Platform)

– Two-Factor Authentication (2FA) is offered as an additional security measure to protect Bidder and Seller Accounts

– Facilitation Services are offered by Exclusive to help facilitate and complete a smooth Sale/Purchase transaction between Buyer and Seller

– Listing Condition Rating: (Sellers to provide an honest assessment of Listing condition with supporting photos/video and/or PPI Report evidence)

  • A = Exceptional (Concours Quality or Brand New/Never Used, Only a tiny fraction of Listings qualify as an A rating, Listing is truly the “Best of the Best”)
  • B = Excellent (Listing has no major visual, structural or mechanical flaws and operates as new i.e. “Garage Queen”)
  • C = Great (Listing has a few minor flaws and is fully operational i.e. “Road Ready / Race Ready” The vast majority of Listings usually qualify as a C or D rating)
  • D = Good (Listing has a number of identifiable flaws but is fully operational i.e. “Daily Driver” The vast majority of Listings usually qualify as a C or D rating)
  • E = Fair (Listing has significant flaws, wear & tear, operational issues, needs repairs, etc. i.e. “Project Car”)
  • F = Poor (Listing is incomplete, non-operational and severely compromised i.e. “Parts / Donor Car”)

– Option 1) Reserve Auction (Listing will only sell if Highest Bid amount meets or exceeds set Reserve Price)

– Option 2) No-Reserve Auction (Listing will sell to highest Bidder regardless of Bid amount)

– Option 3) Buy Now / Make Offer (Listing will sell to the first Bidder that pays the Buy Now Price or Seller may accept Bidder’s Make Offer Price)

– Option 4) Hybrid Auction (Reserve Auction + Buy Now / Make Offer) (Listing will sell if Highest Bid amount meets or exceeds set Reserve Price or to the first Bidder that pays the Buy Now Price or Seller may accept Bidder’s Make Offer Price)

– Listings go Live to Preview on the Platform upon completion of Listing input and approval process with the following Auction Options for Sellers:

  • 3 Day Auction Option
    • Auctions Start every Tuesday at 00:00 UTC
    • Auctions End Three (3) Days later on Thursday at 23:59 UTC
    • In the event the Auction ends and the Reserve Price has not been met (or no bids were received in a Reserve or No-Reserve Auction) the Listing may be Re-Run at Auction as follows: (Listing remains Live on the Platform during Non-Auction periods for the entire 90 Day Listing Period with Bidders able to Make Offers through the Make Offer Button)
      • Weekly Auction Run for the 90 Day Listing Period
      • Bi-Weekly Auction Run for the 90 Day Listing Period
      • Once per Month Auction Run for the 90 Day Listing Period
      • One & Done Auction Run for the 90 Day Listing Period (Auction runs One Time with no Auction Re-Runs)
  • 7 Day Auction Option
    • Auctions Start every Tuesday at 00:00 UTC
    • Auctions End Seven (7) Days later on Monday at 23:59 UTC
    • In the event the Auction ends and the Reserve Price has not been met (or no bids were received in a Reserve or No-Reserve Auction) the Listing may be Re-Run at Auction as follows: (Listing remains Live on the Platform during Non-Auction periods for the entire 90 Day Listing Period with Bidders able to Make Offers through the Make Offer Button)

  • Seller may cancel Listing at any time, Except during Listing’s Live On-Line Auction Period(s)
  • Communication Management (All Communication between Bidders & Sellers is Monitored & Managed through the Exclusive Auctions Platform)
  • Facilitation Services are offered by Exclusive to help facilitate and complete a smooth Sale/Purchase transaction between Buyer and Seller

– Seller Chooses Sales Success Fee Option During Listing Creation

  • Option 1) Buyer’s Premium – Buyer pays the entire Sales Success Fee in the form of a Buyer’s Premium (Seller Pays Nothing)
  • Option 2) Split Fees – Buyer and Seller Split the Sales Success Fee
    • Buyer pays 1/2 of Total Sales Success Fee in the form of a Buyer’s Premium
    • Seller pays 1/2 of Total Sales Success Fee in the form of a Seller Commission
  • Option 3) Seller Commission – Seller pays the entire Sales Success Fee in the form of a Seller Commission (Buyer Pays Nothing)
  • Vehicle Sales Success Fees (Autos, Motorcycles, Aircraft, Watercraft)
    • 5% Sales Success Fee on Final Sale Amount (For Vehicles Sold Below $200,000 Price Point)
      • Sales Success Fee Minimum $500
      • Sales Success Fee Maximum $5,000 on Final Sale Amounts up to $200,000
      • Ex 1: Listing Sale Price = $3,000 | Sales Success Fee = $500 (Minimum Sales Success Fee)
      • Ex 2: Listing Sale Price = $50,000 | Sales Success Fee = $2,500 (5% Sales Success Fee)
      • Ex 3: Listing Sale Price = $100,000 | Sales Success Fee = $5,000 (5% Sales Success Fee)
      • Ex 4: Listing Sale Price = $200,000 | Sales Success Fee = $5,000 (Maximum Sales Success Fee)
    • 2.5% Sales Success fee on Final Sale Amount (For Vehicles Sold Above $200,000 Price Point)
      • Ex 1: Listing Sale Price = $225,000 | Sales Success Fee = $5,625 (2.5% Sales Success Fee)
      • Ex 2: Listing Sale Price = $300,000 | Sales Success Fee = $7,500 (2.5% Sales Success Fee)
  • Non-Vehicle Sales (Equipment and/or Items, Ex: Engines, Parts, Memorabilia, Bicycles, Watches, Clothing, Shoes, etc.)
    • 10% Sales Success Fee on Final Sale Amount (For Non-Vehicles Sold Below $100,000 Price Point)
      • Sales Success Fee Minimum $50
      • Sales Success Fee Maximum $5,000 on Final Sale Amounts up to $100,000

– If you use the Exclusive Auctions Platform in any way, including but not limited to: viewing Listings, posting a Listing, placing a Bid or utilizing Exclusive’s Website Platforms in any manner whatsoever, you agree to and are bound by the Terms & Conditions of the Platform, including the Process and FAQ Pages contained within the Website Platform

  • Listing Cancellation Policy
    • Seller may cancel Listing at any time, Except during Listing’s Live On-Line Auction Period(s)
    • Seller may cancel the Listing prior to the start of a Live On-Line Auction Period or at the conclusion of a Live On-Line Auction Period (if there is no sale)
    • There is no refund of any Listing Fees paid (if any Listing Fees were assessed) if Seller cancels the Listing
  • Seller may adjust the Listing (pricing, text, photos, videos, etc.) at any time during the Listing Period through Seller Dashboard (some restrictions apply during the Live On-Line Auction Period)
  • Communication Management (All Communication between Bidders & Sellers is Monitored & Managed through the Exclusive Auctions Platform)
  • During the Live Auction Periods and through Buy Now / Make Offer:
    • A Bid that meets or exceeds the Reserve Price set by the Seller or any Bid placed in a No-Reserve Auction, received during the Live Auction Period, will automatically win the Listing and Seller must be able to deliver the Listing to the winning Bidder
    • A Bid that meets or exceeds the Buy Now Price set by the Seller, placed through Buy Now / Make Offer, will automatically win the Listing and Seller must be able to deliver the Listing to the winning Bidder
    • An Offer that is accepted by the Seller, placed through Buy Now / Make Offer, will automatically win the Listing and Seller must be able to deliver the Listing to the winning Bidder
  • Buyers and Sellers shall not engage in any activity designed to complete or facilitate a transaction between the Buyer and Seller for the sale or purchase of a Listing outside of the Exclusive Auctions Platform during the contracted Listing Period Timeframe (Listing Period Timeframe includes: Scheduled Live Auction and Buy Now / Make Offer Periods as defined by the Listing Plan selected by the Seller at the time of Listing creation)
    • If the sale of a Listing is concluded outside of the Platform during the contracted Listing Period to a Buyer Registered on the Platform, Exclusive will charge the Seller’s Payment Account (charging the Seller credit card on file) the entire Sales Success Fee regardless of Sales Success Fee Option selected
      • For Reserve Auction – Seller will be charged the Sales Success Fee based upon the higher of: Reserve Price (as set by the Seller for the Listing) or Highest Bid placed
      • For No Reserve Auction – Seller will be charged the Sales Success Fee based upon Highest Bid placed
      • For Buy Now / Make Offer – Seller will be charged the Sales Success Fee based upon the higher of: Buy Now Price (as set by the Seller for the Listing) or Highest Offer placed
      • For Hybrid Auction – Seller will be charged the Sales Success Fee based upon the higher of: Reserve Price, Buy Now Price (both as set by the Seller for the Listing), Highest Bid or Highest Offer placed
  • There are NO REFUNDS of Seller Commission (if any paid by Seller)
    • Exception 1: In the event that within Seven (7) days (or other agreed upon time-frame, as agreed between Buyer and Seller) of notification to Buyer of Winning Bidder status, Buyer and/or Seller obtain a PPI (Pre-Purchase Inspection Report) and PPI exposes major issues with the Listing preventing Buyer from completing the transaction:
      • Exclusive will return to Seller an amount equal to any Seller Commission (as defined herein) paid by Seller minus any fees or administrative charges incurred by Exclusive to produce said refund
    • Exception 2: In the event that within Seven (7) days (or other agreed upon time-frame, as agreed between Buyer and Seller) of notification to Buyer of Winning Bidder status, Buyer fails to pay Seller in full for the Listing:
      • Exclusive will return to Seller an amount equal to any Seller Commission (as defined herein) paid by Seller
      • Buyer will be liable to Exclusive for any amount refunded to Seller and any fees or administrative charges incurred by Exclusive to produce said refund
      • Buyer will not be entitled to the return of any fee(s) paid by Buyer on account of the sale
      • Buyer will be charged the entire Sales Success Fee regardless of Sales Success Fee Option selected
      • Said amounts will be charged to the Buyer’s Payment Account (charging the Buyer credit card on file)
  • There are NO REFUNDS of Buyer’s Premium (if any paid by Buyer)
    • Exception 1: In the event that within Seven (7) days (or other agreed upon time-frame, as agreed between Buyer and Seller) of notification to Buyer of Winning Bidder status, Buyer and/or Seller obtain a PPI (Pre-Purchase Inspection Report) and PPI exposes major issues with the Listing preventing Buyer from completing the transaction:
      • Exclusive will return to Buyer an amount equal to any Buyer’s Premium (as defined herein) paid by Buyer minus any fees or administrative charges incurred by Exclusive to produce said refund
    • Exception 2: In the event that Seller fails to make a purchased Listing available for transfer to Buyer within 72 hours (or other agreed upon time-frame, as agreed between Buyer and Seller) of Buyers payment in full of the purchased Listing:
      • Exclusive will return to Buyer an amount equal to any Buyer’s Premium (as defined herein) paid by Buyer
      • Seller will be liable to Exclusive for any amount refunded to Buyer and any fees or administrative charges incurred by Exclusive to produce said refund
      • Seller will not be entitled to the return of any fee(s) paid by Seller on account of the sale
      • Seller will be charged the entire Sales Success Fee regardless of Sales Success Fee Option selected
      • Said amounts will be charged to the Seller’s Payment Account (charging the Seller credit card on file)
  • ALL Listings are Sold “AS IS, WHERE IS” (All Listings offered for sale through EXCLUSIVE AUCTIONS are sold “AS IS, WHERE IS,” WITHOUT ANY WARRANTY FROM EXCLUSIVE AUCTIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY)
  • Any Warranties offered by the Seller for a particular Listing are “Offered Exclusively by the Seller and are the Seller’s responsibility for the validity of a particular warranty”
  • The content presented in each Listing is provided by the Seller placing the Listing
  • The content material, accuracy and representations made, are the sole responsibility of the Seller posting the Listing
  • Exclusive Auctions is not responsible for the content material, accuracy, representations or misrepresentations of any Listing posted on the platform
  • Exclusive Auctions reserves the right to review, edit, modify or refuse any Listing submitted for consideration
